Литовські Статути Великого князівства Литовського з погляду гендерної експертизи

Анотація

У статті розглядається законодавство ранньомодерної доби, тобто Литовські Статути Великого князівства Литовського, з погляду гендерного аналізу. Термін «гендер» вживається не в біологічному значенні, а як система міжособистісної взаємодії, тобто як соціальний конструкт, що є основою стратифікації суспільства за статевою ознакою. Гендер вважають однією із трьох (нарівні з расою і класом) найважливіших домінант, що формують синергетичні системи панування і підлеглості. Тому законодавство XVI–XVII ст. розглядається відносно рівності прав і можливостей для різних статей. Оскільки проблема взаємостосунків між чоловіком і жінкою лежить у площині гендерної історії, тож з’ясо­ву­вати її потрібно за допомогою методів гендерної історії.
Гендерній експертизі піддаються перша (1529) і друга (1566) редакції Литовського Статуту. Третя редакція (1588) не береться до уваги, оскільки внаслідок Люблінської унії (1569) українські землі увійшли до складу Речі Посполитої, тож на ці території Статут 1588 р. не поширювався, тут продовжував діяти Статут 1566 р. Аналізується комплекс правових норм тих розділів ЛС, які формували підвалини соціальних інститутів, у першу чергу – родини, а отже, безпосередньо впливали на гендерні стосунки.
На підставі аналізу законодавчих норм ЛС автор доводить, що законодавство ранньомодерної доби базувалося на гендерних нормах і гендерних ідентичностях, забезпечуючи при цьому пріоритетні позиції чоловічої статі, що виключало рівні права і можливості для жіночої статі. Таким чином, уже на законодавчому рівні норми ЛС закладали умови для конструювання гендерної асиметрії, яка призводила до дискримінації жіночої статі й домінування іншої – чоловічої.
